论“一带一路”对外投资争端预防机制的构建
摘 要
“一带一路”倡议对中国和相关国家、地区乃至全世界来说既是机遇也是挑战。随着跨境投资的增长，投资过程中发生的摩擦和纠葛也在增加，然而现有的投资争端解决机制的改革跟不上投资环境的变化，因此，构建一个契合“一带一路”精神、适应沿线国国情的投资争端预防机制是当务之急。中国应带领“一带一路”沿线发展中国家主动参与、相互交流，借鉴现有国际经验，结合沿线国家的国情与发展需求，从国内和国际两个层面防范风险，建立预警和监督机制，增进机制之间的互动，从而有效避免投资争端，营造和谐的国际投资环境。
The Belt and Road is both an opportunity and a challenge for China and other countries and even the whole world. With the growth of cross-border investment, the frictions and disputes in the investment process are also increasing. However, the reform of the existing investment dispute settlement mechanism can not keep up with the changes in the investment environment. Therefore, it is imperative to build a mechanism of investment dispute prevention that fits the spirit of The Belt and Road and fits the national conditions along the line. China should lead the developing countries along The Belt and Road to take the initiative to participate and interact with each other, draw lessons from the existing international experience, combine the national conditions and development needs of the countries along the line, guard against risks from two levels, the domestic and international levels, establish early warning and supervision mechanisms, and enhance the interaction among the mechanisms so as to effectively avoid investment disputes and create a harmonious international investment environment.
